HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CPSW No. 154/2016 in SWP No. 1138/2015 Zaffar Iqbal ….Petitioner(s)/Appellant(s) Through :- Ms. Manpreet Kour, Advocate V/s Sandeep Kr Nayak, Secy. PDD and others ….Respondent(s) Through :- Mr. Meharban Singh, AAG Coram: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER(ORAL) 07.08.2026 01. The instant contempt petition arises out of the order/judgment passed by the learned Writ Court dated 21.04.2015 in SWP No. 1138/2015 by virtue of which the writ petition preferred by the petitioner was disposed of in the following manner: “In view of the above, the writ petition is disposed of with a direction to the respondents to consider the claim of the petitioner in accordance with rules and having due regard to judgment passed in LPASW No. 50/2010, provided the same is applicable in the case in hand and pass consideration order within a period of two weeks from the date certified copies of this order and order dated 26.11.2010 are made available to the respondents.” 02. Mr. Meharban Singh, learned AAG appearing on behalf of the respondents submits that the order/judgment passed by the learned Writ Court stands complied with and a detailed consideration order has been passed rejecting the case of the petitioner and therefore, the order/judgment passed by the learned Writ Court, according to the learned counsel for the respondents, stands complied with. 03. I am in agreement with the arguments advanced by the learned counsel for Sr. No. 201 2 CPSW No. 154/2016 the respondents that the order/judgment was only to the extent of to accord consideration, which consideration has been accorded and the claim of the petitioner for compassionate appointment has been rejected by virtue of Order No.CEJPDCL/LIT/10 of 2026 dated 01.08.2016, same has been provided to this Court along with the statement of facts/compliance report, which has been taken on record. 04. In the light of the stand taken by the respondents and also in the light of the detailed consideration order, no fruitful purpose would be served to keep this contempt petition alive as the order/judgment passed by the learned Writ Court stands complied with. Accordingly, the proceedings in the contempt petition are closed. Rule, if any, stand discharged. However, dismissal of the instant contempt petition shall not come in the way of the petitioner to agitate the cause afresh challenging the aforesaid consideration order by way of appropriate proceeding, if so advised.
