HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CJ Court Case: CPSW No. 459/2016 in SWP No. 1891/2016 Rabia Tabassum ….. Appellant/Petitioner(s) Through: None Vs M.A. Rather and others .…. Respondent(s) Through: Ms. Saliqa Sheikh, Assisting counsel to Mr. Raman Sharma, AAG Coram: HON’BLE THE CHIEF JUSTICE ORDER 04.05.2026 1. Vide this petition, the petitioner seeks initiation of contempt proceedings against the respondents for willful/intentional defiance of the order dated September 09, 2016, rendered in SWP No.1891/2016. 2. A bare reading of the order referred to above reveals that the petition preferred by the petitioner was disposed of by the Writ Court providing that the petitioner shall appear before the standing Medical Board of the Government Medical College, Jammu on September 19, 2016, and would be examined by the Board. Whereupon, the Chief Education Officer, Doda, would accord consideration to the opinion of the Medical Board and assign the petitioner a suitable posting. 3. Statement of facts on behalf of respondent Nos. 1 to 3 has been submitted. Per which, the Directorate School Education, Jammu, after examining the case of the petitioner had conveyed the Chief Education Officer, Doda, that since the petitioner’s appointment happened to be school specific, therefore she would have to be posted in the school wherefrom she was initially engaged till some policy as regards the transfers was notified. 4. Moreover, even the Medical Board’s opinion produced by the petitioner would not indicate any life consuming or severe disease she was suffering from. Sr.No. 16 2 CPSW No. 459/2016 in SWP No. 1891/2016 Accordingly it was concluded that no case for retention of the petitioner was made out and as such she was directed to report Headmaster GPS Ludna in Zone Gundna for further duties. 5. That being so, nothing substantive survives in the petition and the same is accordingly disposed of as having been rendered infructuous. ( (ARUN PALLI) CHIEF JUSTICE Jammu 04.05.2026 AKHILESH
