HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CJ Court Case: CPSW No. 501/2016 in SWP No. 637/2016 Abdul Momin and another ….. Appellant/Petitioner(s) Through: None Vs M.A. Mir and others .…. Respondent(s) Through: Ms. Sagira Jaffer, Advocate Coram: HON’BLE THE CHIEF JUSTICE ORDER 04.05.2026 Vide this petition, the petitioners pray for initiation of contempt proceedings against the respondents for willful/intentional defiance of the order dated March 30, 2016, rendered in SWP No. 637/2016. A bare reading of the order referred to above shows that the writ Court while issuing notice in the main case as also in the miscellaneous petition had directed the respondents to consider the claim of the petitioners in the wake of its earlier decision dated December 31, 2014 passed in SWP No. 487/2009. Response on behalf of respondent Nos. 1 and 2 has been submitted. Learned counsel for the respondents submits that in terms of the order of this Court dated March 30, 2016, claim of the petitioners was considered and rejected by the competent authority, for, it was found that the petitioners was not similarly circumstanced as the petitioners in SWP No. 487/2009 decided on December 31, 2014. The records show that, in fact, the main case itself was transferred by this Court to the Central Administrative Tribunal, Jammu on October 28, 2021. None is present either on behalf of the petitioners to point out if the lis between the parties still survives or the matter is still pending before the Tribunal. That being so, the Court is choiceless, but to dismiss the petition for non-prosecution. ( (ARUN PALLI) CHIEF JUSTICE Jammu 04.05.2026 AKHILESH Sr.No. 29
