HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CJ Court Case: CPSW No. 408/2016 in SWP No. 1309/2001 Ram Lal & Ors. ….. Appellant/Petitioner(s) Through: None Vs M K Bhandari, Secy. Med. Education & Ors. .…. Respondent(s) Through: Ms. Saliqa Sheikh, Assisting Counsel vice Mr. Raman Sharma, AAG Coram: HON’BLE THE CHIEF JUSTICE ORDER 24.04.2026 Per the statement of facts/compliance report submitted on behalf of the respondents, the competent authority upon consideration of the claim of the petitioners, rejected the same vide order dated January 30, 2017: <3. That in compliance to the judgment passed by the Hon’ble High Court the claim of the petitioners has been examined and it has been found that the petitioners have been appointed in the 1993 after coming into force SRO 75/1992. In terms of the said SRO fresh Medical Assistants were to be placed in lower cadre. It is also found that the petitioners are not similarly situated with Medical Assistant/Pharmacist in SWP No. 1282/1997- titled Ajit Singh & Ors V/s State and ors as they were not part & parcel of the selection process initiated in the year 1987. Hence no similarity of fact was found between the petitioners and accordingly the claim of petitioner has been rejected. Copy of order dated 30.01.2017 passed by the Director Health Services Jammu is enclosed herewith as Annexure R-1.= That being so, nothing substantive survives in the petition and the same is, accordingly, disposed of as having been rendered infructuous.
