Vide this petition, the petitioner seeks initiation of the contempt proceedings against the respondent-Authorities for willful/deliberate violation of the order/judgment dated January 27, 2016 rendered in SWP No. 51/2016.
A bare reading of the order referred to above reveals that the petition preferred by the petitioner was disposed of with the direction to the respondents to consider the claim of the petitioner for release of retiral benefits. And in case he is found entitled, the same be released within a period of four weeks thereafter.
Detailed objections/statement of facts have been submitted by the respondents and with reference to the averments setout therein, it is prayed that the petition being misconceived, the same be dismissed.
The matter is pending for over a decade and none is present either on behalf of the petitioner to clarify if anything actually survives for consideration. That being so, the Court is choiceless, but to dismiss the petition for non- prosecution.
