By way of the present petition, the petitioner seeks quashing of the summoning order dated 03.08.2015 and Complaint Case No. 426/12/13, subsequently numbered as C.C. No. 50026/2016, titled Anil Kumar Garg v. Archana Gupta, pending before the learned ACMM, East District, Karkardooma Courts, Delhi, for offences punishable under Sections 499/500/181/191 of the Indian Penal Code, 1860 (hereinafter referred to as ‘IPC’), and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties. Petitioner and Respondent are present before this Court and have been duly identified by their respective learned counsel and the Investigating Officer. 4. The brief facts of the case are that the present proceedings arise out of disputes between the parties, pursuant to which Complaint Case No. 426/12/13 was instituted by Respondent No. 1 against the petitioner under Sections 499/500/181/191 of the IPC. The petitioner was summoned vide order dated 03.08.2015 and has thereafter approached this Court seeking quashing of the said proceedings. 5. It is submitted that during the pendency of the present proceedings, the parties have amicably resolved all their disputes and differences and have executed a Memorandum of Understanding dated 30.04.2024. 6. As per the terms of the Memorandum of Understanding, Respondent No. 1 has agreed to make statements before the concerned Courts and to take necessary steps for withdrawal/quashing of the proceedings initiated by him against the petitioner and other persons, including FIR No. 75/2013 registered at Police Station Naraina, Delhi, as well as the FIRs pending before the competent Courts in Uttar Pradesh. The settlement also records the undertaking of Respondent No. 1 to withdraw the complaint titled Archana Gupta v. Anil Kumar Garg pending before the District Consumer Forum, Ghaziabad, upon fulfilment of the terms stipulated therein. 7. Respondent who has been duly identified by his learned counsel states that he has entered into the settlement dated 30.04.2024 out of his own free will and volition and without any force, fraud, coercion, undue influence or pressure. Respondent further states that he shall abide by the terms and conditions of the Memorandum of Understanding dated 30.04.2024 and shall take the requisite steps for withdrawal/quashing of the other proceedings, as stipulated therein. The parties undertake to remain bound by the terms and conditions of the said Memorandum of Understanding in letter and spirit. 9. This Court has considered the settlement arrived at between the parties and the statements made by the parties in Court. The parties have amicably resolved their disputes out of their own free will and volition. Respondent has categorically stated that he has no objection to the quashing of the complaint proceedings pending against the petitioner. 10. In view of the settlement arrived at between the parties and the statement made by Respondent, no useful purpose would be served by permitting the criminal proceedings arising out of Complaint Case No. 426/12/13 to continue. Continuation of the said proceedings would also be contrary to the settlement arrived at between the parties. 11. Accordingly, the summoning order dated 03.08.2015 and Complaint Case No. 426/12/13, subsequently numbered as C.C. No. 50026/2016, titled Anil Kumar Garg v. Archana Gupta, for offences punishable under Sections 499/500/181/191 of the IPC, pending before the learned ACMM, East District, Karkardooma Courts, Delhi, along with all consequential proceedings emanating therefrom, are hereby quashed. 12. In view of the settlement between the parties and the orders passed in the connected matters, CRL.M.C. 135/2015, whereby quashing of FIR No. This is a digitally signed order.
