The present appeal has been filed seeking setting aside of the judgment and decree dated 18th November, 2025 passed by the Additional District Judge-05, West Delhi, Tis Hazari Courts, Delhi. By way of the impugned judgment, the suit filed by the plaintiff/appellant seeking recovery has been dismissed. 2. Counsel for the parties were heard on various dates and were encouraged to settle their disputes. This is a digitally signed order. In terms of the oral settlement arrived at between the parties, the appellant is agreeable to withdraw the present appeal subject to the respondent not pressing her claim for recovery of Rs. 5,00,000/- that was paid by the respondent to the appellant during the proceedings before the trial court. 5. The respondent who is present in Court is agreeable to same. 6. Accordingly, in light of the aforesaid settlement, the present appeal is dismissed as withdrawn. 7. In view of the settlement arrived at between the parties, Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the appellant, in terms of Section 16 of the Court Fees Act, 1870 read with Section 89 of the Code of Civil Procedure, 1908.
