The present writ petition is filed challenging the recovery certificate dated 08.01.2016 and attachment order dated 11.02.2016 on the ground that no order for recovery could have been passed since the entire amount had already been paid. 5. He submits that the calculation was specifically produced before the learned Deputy Labour Commissioner, who after going through the same as well as the reply filed by the department had issued the certificate for recovery of the amount. 6. He however does not dispute that no reason has been mentioned in the impugned recovery certificate. 7. The learned counsel fairly submit that they would be satisfied if the labour commissioner is directed to pass an order afresh after hearing both the parties. 8. In view of the above, the recovery certificate dated 08.01.2016 and attachment order dated 11.02.2016 are set aside. The concerned Deputy Labour Commissioner is directed to pass a reasoned order afresh within four weeks after hearing both the parties. 9. The parties are directed to appear before the concerned Deputy Labour Commissioner on 10.08.2026 at 2 PM. 10. A copy of this order be communicated to the concerned Deputy Labour Commissioner through the learned Standing Counsel, GNCTD. 11. The petition stands disposed of in the aforesaid terms.
