The present Petition seeks initiation of Contempt Proceedings on the ground of the alleged willful disobedience of the Order dated 16.11.2015 passed by a Co-ordinate Bench of this Court in LPA No.801/2015 titled as “Arjun Chowdhary & Ors Vs Capital Land Builder Pvt. Ltd”. The Petitioner also seeks that a direction be passed to restore all the requisite documents which have allegedly been removed in defiance of Order dated 16.11.2015. The relevant part of the aforesaid Order reads as under: “12. The said para (iii) will be implemented by respondent Nos.1 to 3 as follows: "(iii) The documents which are under dispute / filed by the unauthorized persons in the company may be marked as disputed documents so that no certified copy of those documents could be issued in future."” 2. Learned counsel for the Respondents draws the attention of this Court to the Affidavit dated 11.02.2016 and, in particular, Paragraph Nos.7 and 8 thereof, which read as under: This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 13/07/2026 at 15:16:48 “7. I say that the documents identified as disputed/filed by unauthorized person have been marked as disputed by Infosys which can be seen from the attached screenshot. The said documents are not available for public viewing to prevent the public from applying and obtaining the certified copies of the same. List of 14 SRNs documents identified and marked as 'disputed' and a screenshot is marked and annexed hereto as Annexure B(Colly). 8. I say that the documents which have been marked as 'disputed' have not been removed from the system and can be viewed from the back office, in compliance of order dated 16.11.2015 of this Hon'ble High Court. I further state that no certified copy of the said documents can be issued to any one as directed vide order dated 16.11.2015 of the Hon'ble Division Bench of this Hon'ble Court.” 3. Learned counsel for the Petitioner, when confronted with the aforesaid affidavit and upon perusing its contents, submits that, since the documents have not been removed from the system, no further Order is required to be passed in the present Petition and therefore, on instructions, seeks the liberty to withdraw the same. 4. Liberty, as sought for, is granted. 5. The present Petition, along with pending application(s), is dismissed as withdrawn.
