Learned Standing Counsel appearing on behalf of Municipal Corporation of Delhi [“MCD”] submits that they will be considering the Application/Representation of the Petitioner for processing building plans submitted by the Petitioner in accordance with the applicable laws and Building Bye-Laws without compelling the Petitioner to obtain a No Objection Certificate for the purpose of consideration of the building plans. 2. Learned counsel appearing on behalf of the Petitioner undertakes to ensure that upon filing of a fresh application/representation by the Petitioner, through counsel, within a period of one (01) week from today, the said Application/Representation shall be considered and decision thereof communicated to the Petitioner within a period of four (04) weeks from today. 3. Learned Standing Counsel appearing on behalf of the MCD This is a digitally signed order. Non-Requirement of NOC/ Signatures from Co-owners : The application shall be entertained after ensuring compliance of provisions of Unified Building Bye-Laws-2016, Master Plan-2021, Zoning Regulations and statutory clearances/NOC(s) from the concerned Department(s) if needed. The NOC of the Owner (s) of other floor(s) of the building are not required, in the light of order of Hon'ble High Court of Delhi order in Writ Petition (Civil) tiltled as "Smt. Usha Devi Sharma V/s Commissioner MCD, LPA No. 2008/2005 and (Civil) No. 3280/2004 the Hon'ble Supreme Court of Delhi order in SLP (C) CC No. 5679/2005" and another similar matters.” 4. In the event that there is any violation of the same, the Petitioner is at liberty to revive the present Petition. 5.
