1. This application is filed jointly by the Plaintiff and the Defendant under Order XXIII Rule 3 read with Section 151 CPC for recording the settlement between the parties and to decree the suit in terms thereof. Terms of settlement are incorporated in paragraph 4 of the application. 2. Mr. Rajeev Virmani, learned Senior Counsel for the Plaintiff submits that the suit be decreed in terms of the settlement between the parties but Plaintiff be permitted to place the Settlement Agreement dated 24.02.2026 in a sealed cover to maintain confidentiality. It is also urged that a direction be issued that properties set out in Annexure-1 to the Settlement Agreement be attached, to be released from attachment by release of Title Deeds of a This is a digitally signed order. particular property as set out in Clause 2.6 of the Agreement upon payment of agreed instalments. Direction is sought for release of handsets (mobile devices) filed before this Court as also confidential documents filed in a sealed cover and joint statements filed by economic experts appointed by the parties to the counsel for the Plaintiff. Mr. Virmani submits that in light of the settlement, counter claims bearing No. CC(COMM) 1/2019 to 8/2019 be dismissed as withdrawn. 3. Counsel for Defendant has no objection to the reliefs sought in the application being granted. 4. Court has perused the terms of settlement and finds the same to be lawful. This application is accordingly disposed of recording the settlement between the parties and permitting the Plaintiff to place the Settlement Agreement dated 24.02.2026 in a sealed cover before this Court within two weeks.
The sealed cover shall be retained with the Dealing Assistant until further orders of this Court in this behalf. CS(COMM) 769/2016
5. The suit is decreed in terms of settlement between the parties, which are incorporated in a Settlement Agreement executed and signed on
24.02.2026. 6. Registry is directed to draw up the decree sheet. 7. Properties set out in Annexure-1 of the Settlement Agreement are attached and will be released from attachment by release of Title Deeds in terms of Clause 2.6 of the Agreement as and when the instalments are paid in respect of the concerned property. 8.
