1. This hearing has been done through hybrid mode. 2. The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958 seeks the following prayers:
“In view of the submissions made hereinabove, it is, therefore, most respectfully prayed that the order dated 08/12/2015 may kindly be set aside and the revisionist's application for the leave to contest the eviction petition may kindly be allowed.”
3. On 23.12.2025, learned Predecessor Bench of this Court had passed the following order: -
“1. Apropos the order dated 18.12.2025, learned counsel for the parties, after consulting the respective tenant and landlord, submit that the parties have agreed that the tenant shall hand over the vacant, peaceful and physical possession of the subject premises to the respondent/ landlord on or before 31.03.2026, and shall also pay user and occupation charges @ Rs.1,500/- per month on or before the 7th day of each month to the landlord. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Additionally, the tenant has also agreed to pay/ clear all the charges levied towards electricity and water charges, as also the RWA dues, including all other statutory dues qua the subject premises, and hand over all the requisite documents reflecting the payment(s) of each of the above to the landlord on or before the said date, i.e. 31.03.2026. 3. At this stage, learned counsel for the tenant seeks, and is granted, a period of two weeks, to file an affidavit of undertaking in terms of the aforesaid. 4. Renotify on 14.01.2026.”
4. The said affidavit of undertaking was placed on record on 11.02.2026, and on 13.02.2026, following order was passed by this Court: -
“1. This hearing has been done through hybrid mode. 2. The affidavit of undertaking in terms of order dated 23.12.2025 has been placed on record. 3. Learned counsel for the respondent submits that in para 2 of the said affidavit, the property is described in the following manner:-
“…2. That the deponent undertakes that he would hand over the vacant physical possession of the premises i.e. two room on first floor at property bearing no.
1939, Gali Durga Mandir, Lal Kuan, North Delhi, G.P.O. Delhi-110006 admeasuring 8’x9’ one room and the verandah and the toilet is common for the use of all the tenant...”
4. It is pointed out that the subject premises are actually on the ground floor. 5. The petitioner, who appears in-person, confirms the aforesaid and undertakes that he shall vacate the subject property by 31.03.2026. 6. 5. None appears on behalf of the petitioner today. 6.
Learned counsel for the respondent submits that the possession of the said premises has been handed over on 31.03.2026 to the respondent and the petitioner has also cleared the use and occupation charges in terms of the order dated 23.12.2025 as also the aforesaid affidavit of undertaking.
7. In view of the aforesaid circumstances, no further direction is called for and the present petition stands disposed of accordingly.
