Appellants have filed an appeal for enhancement of the award dated 10.03.2016 passed by the Learned MACT, awarding a compensation of Rs. 9,10,000/- along with interest @ 9% p.a. from the date of filing of claim petition. 2. After comprehensive discussion, it is agreed between the parties that the appellants shall get enhanced amount of Rs. 3,50,000/- as lump sum compensation over and above the award of the learned Tribunal as full and final compensation. 3. Learned counsel for the Insurance Company submits that the Driver This is a digitally signed order. The Order is downloaded from the DHC Server on 25/03/2026 at 13:02:29 and the Owner of the vehicle have not challenged the recovery right granted by the learned Tribunal. It cannot be disputed that the respective legal rights of the parties are reserved, as per the law. The Lok Adalat Court cannot pass an order to modify the recovery right already granted by the learned Tribunal. 4. Insurance Company is directed to deposit Rs. 3,50,000/- before the concerned Tribunal within a period of six weeks from today, failing which, same shall carry interest @9% p.a., on the delayed deposit. 5. In the instant appeal, we find that in the pre-sitting Lok Adalat, appellant Nos. 1 to 3 were present in person and instructions have been given to their counsel that the payment of the enhanced amount be released to the appellant No.1-Smt. Sunit Devi Joshi. 6. Learned counsel for the Insurance company seeks some time to deposit the said amount. 7. On deposit, the amount shall be released in favour of appellant No.1, namely, Smt. Sunita Devi Joshi on compliance of all the requisite formalities. 8.
