National Lok Adalat FAO No.961 of 2016 (O&M) (533) Present: Mr. P.H.S. Pannu, Advocate for the appellants. Ms. Ajita Dixit, Legal Manager for the respondent No.3– Insurance Co. Ltd. **** The present appeal has been filed raising challenge to the award dated 18/20.04.2015 passed by Learned MACT Tribunal, Karnal, whereby, the claim of the appellants has been dismissed. However, as agreed, as per statements of learned counsel for the appellants, learned counsel and representative of the respondent-Insurance Company (separately recorded) a sum of Rs. 5,00,000/- (Rupees five lakhs only) as full and final settlement of the claim in this appeal. As per the statement of learned counsel for the appellants, the enhanced amount be paid to appellant No. 1. Accordingly, we dispose of the present appeal with a direction to the Insurance Company to deposit a cross-cheque for Rs. 5,00,000/- (Rupees five lakhs only) in the name of appellant No. 1 with the office of the Lok Adalat of the High Court within a period of 08 weeks from today, in compliance of this order, failing which, interest @ 9 % per annum shall follow on this amount from the date of this order till the payment is made. The concerned Officer of the Lok Adalat Branch/Office shall issue proper receipt after receiving the cheque to learned counsel/representative of the respondent- PARUL 2026.05.18 13:10 I attest to the accuracy and authenticity of this document/order FAO No.961 of 2016 (O&M) 2 Insurance Company. The appellant(s)’ counsel/appellant(s) may collect the cheque from the office of the Lok Adalat. The amount be remitted to appellant No. 1, however, in case, any other claimant has any objection, they will be at liberty to claim the same as per the apportionment done by learned Tribunal vide order dated 18/20.04.2015. Copy of the order be supplied/sent to the counsel/parties and file be returned to the Hon’ble High Court. Pending application, if any, shall stand disposed of.
