1. The present Civil Writ Petition under Articles 226/227 of the Constitution of India is filed for the issuance of a writ in the nature of mandamus directing respondents No. 1 to 4 to release the arrears of Dearness Allowance (DA) for the period from 01.01.2016 to 30.11.2023, which have not been released till date. It is further prayed that the PARUL VERMA 2026.05.04 09:31 I attest to the accuracy and authenticity of this
order/judgment.
respondents be directed to release the arrears of pension for the period from 01.01.2016 to 30.06.2021, either in lump sum or in three instalments, in terms of Circular No. 3/23/2009/3/FPPC-1174 dated 29.09.2010 and that the respondents be directed to release the balance three instalments of DA reflecting the increases from 38% to 42% and from 42% to 46%, and to grant revised pension to the petitioners in accordance with the Pay Commission Report dated 18.06.2021.
2. Reply by way of affidavit of Mr. Nitin Kumar, Deputy Secretary Finance-1, Punjab State Power Corporation Limited, Patiala, on behalf of respondents No.1 to 4, has been filed in Court today and is ordered to be taken on record. The Registry is directed to place the same at an appropriate place. A copy thereof has been supplied to learned counsel for the petitioners in Court.
3. Before commencement of the arguments, learned counsel for the parties are ad idem that similar issue has been decided by this Court in
Versus Additional Chief Secretary to Government of Punjab, Department of Finance, Punjab Civil Secretariat, Chandigarh -.-/-0 and the present petition may be disposed of in terms of the said judgment.
4. In view of the statement made by learned counsel for the parties, as well as the fact that the petitioners are pensioners who retired between the years 1996 and 2010, and upon perusal of Annexure P-12, it is PARUL VERMA 2026.05.04 09:31 I attest to the accuracy and authenticity of this
order/judgment.
1 evident that the respondent-Corporation has taken a specific stand that as and when a decision is taken by the Government of Punjab to release the arrears of Dearness Allowance/Dearness Relief, the same shall be paid to the petitioners, therefore, the present petition is disposed of in terms of Nirmal Singh Dhanoa and others (supra). 2
