Ajay Mohan Goel, Judge (Oral) While going through this petition, this Court finds that the reliefs being prayed for herein are the same and similar releifs prayed for by the petitioner in the earlier writ petition, i.e. CWP No. 819 of 2005. 2. Confronted with this issue, learned Counsel for the petitioner submitted that in fact after the decision of the abovementioned writ petition and in compliance thereto, as fresh cause of action has accrued in favour of the petitioner, the intent of the petitioner was to agitate those issues. He further submitted that in the interest of justice, this petition be closed by allowing the petitioner to withdraw the same, with liberty to file a fresh petition of the subsequent causes. 3. In light of the prayer made by learned Counsel for the 1 Whether reporters of the local papers may be allowed to see the judgment? 2 petitioner, these proceedings are closed as withdrawn, with liberty to the petitioner to file a fresh petition on the subsequent causes. It goes without saying that as the petitioner was bonafidely pursuing this remedy by way of present petition from the year 2016, the respondents shall not agitate the filing of the fresh petition by the petitioner on the ground of delay and laches.
