The learned Advocate for the Appellant tenders on record the pursis stating that, the Respondent No.1/Original Claimant expired on 05.01.2017 and the Appellant could not trace out the legal representative/legal heirs of the deceased/Respondent No.1. He submits that, the Appellant No.1 be permitted to withdraw the Appeal with liberty to file afresh as and when the legal heirs/legal representatives initiate the execution proceedings or disclose the identity.
