Mr. I. Denning, learned counsel, appears for respondent No. 1. Mat. App. No. 4 of 2016 was filed by respondent No. 3 in Mat. (G&W) Suit No. 25 of 2014 on the file of the Family Court, Manipur at Lamphelpat, aggrieved by the judgment and order dated 26.06.2015 passed therein, appointing the petitioner in the said suit as the guardian of the person and properties of the three minors, namely, (i) Meitankeishangbam Raj Singh, (ii) Meitankeishangbam Ricky Singh and (iii) Km. Meitankeishangbam. The petitioner in the said suit is the elder brother of the father of the minor children, who died on 26.09.2010, while respondent No. 3 in the said suit, the appellant, is their mother. As there was a delay of 25 days in the presentation of the appeal, the appellant filed MC (Mat. App.) No. 2 of 2016 seeking condonation thereof. Notice having been ordered on 17.03.2016, Mr. I. Lalitkumar, learned senior counsel, and Mr. I. Denning, learned counsel, entered appearance for respondent No. 1, the petitioner in the suit.
While so, there was no representation for the applicant/appellant or her learned counsel, Ms. A. Binarani, on 16.03.2022, on 30.05.2022 and on
03.06.2022. In the light of such continued absence, these matters were directed to be listed under the caption ‘Dismissal’ on 07.06.2022. Today, yet again, there is no representation of Ms. A. Binarani, learned counsel for the applicant/appellant. This Court is therefore constrained to draw the inference that the applicant/appellant is not interested in pursuing this litigation. MC (Mat. App.) No. 2 of 2016 is accordingly dismissed for non-prosecution. In consequence, Mat. App. No. 4 of 2016 is also dismissed. In the circumstances, there shall be no order as to costs. JUDGE
