If such an application is filed before the trial Court at any stage where the petitioner deems it fit to agitate his cause, such application shall be heard and disposed off by learned trial Court only on merit, in accordance with law, without being prejudice by the order of this Court, as this Court has not expressed any opinion on the merit of the case.
