The present application has been preferred against the order dated 16.05.2016 passed by Mr. Raman Kumar, the learned Additional District and Sessions Judge-III, Madhepura in connection with Sessions Trial No. 34/2015, arising out of Puraini P.S. Case No. 41 of 2014, whereby the application preferred on behalf of the petitioner for discharge under Section 227 of the Cr.P.C. has been dismissed.

3. Assailing the same order, the petitioner has approached this Court under Section 482 of the Cr.P.C. way- back in the year 2016.
4. Today, when the case is called out, learned counsel for the petitioner prays for the withdrawal of the same with a liberty to raise all the grounds so raised in this application before the competent Court at an appropriate stage.
5. Learned APP appearing on behalf of the State did not object to it.
6. In view of the above, the prayer is allowed.
7. With the aforesaid liberty, the application stands dismissed as withdrawn.
