The present application has been preferred for the following relief(s): for initiating a proceeding of contempt against the Respondents for their willful disobedience to the order and judgment dated 24.07.2015 passed by Hon'ble Mr. Justice Dr. Ravi in CWJ.C NO- Patna High Court MJC No.1683 of 2016(9) dt.09-07-2026 2/3 10662/15 whereby and whereunder this Hon'ble Court was pleased to dispose of the connected writ petition giving liberty to the petitioner to approach the District Magistrate, Sitamarhi by filing a representation alongwith a copy of this order and also with copy of letter dated 06.06.2015 sent by the Block Development Officer, Dumra, Sitamarhi. Further direction was issued that the B.D.O. Dumra will send last pay certificate along with service Book to subsequent place of transfer. The respondents were directed to dispose of the issue by passing a reasoned order within a period of six weeks from the date of filing such representation. 3. Pursuant to the aforesaid order, the Collector, Sitamarhi has passed a reasoned order (Annexure- B to the show cause) communicated to the petitioner vide memo no. 476 dated 29.04.2019. 4. In that background, granting liberty to the petitioner to agitate afresh if he has any grievance again, the file has to be consigned. I.A. No. 01 of 2019 5. The aforesaid I.A. has been preferred for recall of the order dated 01.03.2019 passed by a Co-ordinate Bench Patna High Court MJC No.1683 of 2016(9) dt.09-07-2026 3/3 (Hon’ble Mr. Justice, A.K. Upadhyay, as his Lordship then was) by which a cost of Rs. 50,000 was imposed. 6. A reason given by the opposite party no. 2 stands incorporated in paragraphs 5 to 8 of the petition. 7. In that background, this Court is of the opinion that reason has been given by the opposite party no. 2 and as such, the I.A. No. 01 of 2019 has to be allowed. 8. Accordingly, ordered. 9. The order dated 02.04.2019 by which direction was given to pay Rs. 50,000/- as cost stands recalled. 10. I.A. No. 01 of 2019 is disposed of. 11. MJC No. 1683 also stands disposed of.
