This CMP has been filed challenging the common order dated 16.07.2016 passed by the learned Civil Judge (Junior Division), Kendrapara in Title Suit No. 240 of 1993, (Annexure-5) rejecting the petition filed by the defendants for hearing Civil Suit No.448 of 2008 renumbered as Civil Suit No. 734 of 2013 with Title Suit No. 240 of 1993. 2. On 17.08.2016 while issuing notice, this Court had stayed further proceeding in T.S. No.240 of 1993. 3. On 29.07.2026, a report had been called for from the learned Civil Judge (Junior Division), Kendrapara regarding present status of Civil Suit No.734 of 2013 and T.S. No.240 of 1993. 4. Report dated 04.08.2026 of the learned Civil Judge (Junior Division), Kendrapara has been received, where it is stated that C.S. 448 of 2008 renumber as C.S. No. 734 of 2013 is disposed of on 04.12.2017 as dismissed for default and T.S. No. 240 of 1993 is disposed of on 11.02.2022 as dismissed for default. 5. In view of the disposal of the suits, nothing remains to be decided in this CMP, which is accordingly dismissed. 6. Interim order stands vacated. 7. Misc. Case No. 1103 of 2016 stands disposed of.
