This CMP has been filed challenging the order dated 30.07.2016 passed by the learned 1st Additional District Judge, Rourkela in FAO No. 15 of 2015 dismissing the appeal filed by the Petitioner/defendant no.2 challenging the order dated 11.05.2015 passed in CMA No. 112/2011 arising out of C.S. No. 177/2011 by the learned Civil Judge (Senior Division), Rourkela allowing the application under Order 39, Rules 1 and 2 CPC for temporary injunction filed by the Plaintiff/Opposite Party No.1, thereby restraining the Petitioner/defendant no.2 amongst others from blocking or obstructing, interfering in the suit passage in any manner till disposal of the suit. 2. Although notice has been issued in this case, but no interim order had been passed by this Court. In the meanwhile, almost 10 years have elapsed. 3. On 19.08.2026, Mr. K.M.H. Niamati, learned counsel for the Opposite Party No.1 had sought for time to obtain instructions. 4. Today he submits that C.S. No. 177/2011 has been disposed of on 19.02.2020. 5. In view of the submission of the learned counsel for the Opposite Party No.1 that the suit has been disposed of, no useful purpose will be served by keeping the CMP pending. 6.
