This CMP has been filed challenging the order dated 29.09.2016 passed by the learned District Judge, Kendrapara in F.A.O. No. 312 of 2014 confirming the order dated 28.10.2014 passed by the learned Civil Judge (Junior Division), Aul in I.A. No. 56 of 2014 (arising out of C.S. No. 53 of 2014) filed under Order 39 Rule 1 and 2 read with Section 151 of the CPC by the plaintiff refusing to restrain the Defendant-Opposite Party from dispossessing the petitioner from the suit land or from alienating the suit land or changing the nature and character of the suit land, till disposal of the suit. 3. Notice was issued on 16.12.2016 in the Misc. Case, but no interim order has been passed. 4. On 05.08.2026, when the matter was listed, prayer for adjournment was made by Ms. Swagatika Sahoo, learned counsel for the Petitioner as she wanted time to go through the brief and make a submission on merit in the CMP. On the same day a report had been called for from the learned Civil Judge (Junior Division), Aul regarding present status of the Civil Suit. 5. Report dated 10.08.2026 of the learned Civil Judge (Jr. Division)-Cum-JMFC, Aul reveals that the suit is still pending for recording of evidence from the side of the plaintiff. 6.
