This CMP has been filed challenging the order dated 16.07.2016 and 30.10.2015 passed by the learned Civil Judge (Sr. Division), Khurda in C.S. No. 221 of 2012 (which are part of Annexure-5). On 30.10.2015 oral objection of the plaintiff against the sole defendant under Order 37 Rule 3 of the CPC was rejected and/or 16.07.2016, the application filed under Order 37 Rule 3 of the CPC by the plaintiff was rejected. 3. While issuing notice on 26.10.2016, further proceeding in C.S. No. 221 of 2012 had been stayed by this Court. 4. Mr. B.P. Panda, learned counsel for the Petitioner submits that on verification from the e-Courts website it is found that the civil suit has been dismissed for default on 15.12.2022. The print out produced by him is taken on record. The case number mentioned in the document is C.S. No. 1840 of 2014 but the names of the parties match. 5. Ms. P.S. Mohanty, learned counsel appearing on behalf of sole Opposite Party submits that she does not have any instructions regarding status of the suit. 6. In view of submission of Mr. B.P. Panda, no useful purpose would be served by keeping this CMP pending, which is accordingly dismissed. 7. Interim order passed earlier stands vacated and Misc.
