This CMP has been filed challenging the order dated 25.07.2016 passed by the learned District Judge, Jagatsingpur in RFA No. 08 of 2009, rejecting the application filed by the Respondent No.1 for amendment of the written statement, to introduce a counter claim with plea of ouster. 2. While issuing notice on 31.08.2016, further proceeding in RFA No. 08 of 2009 had been stayed by this Court. 3. Mr. A. Prasad, learned counsel appearing on behalf of Mr. A.P. Bose, learned counsel for the Petitioner submits that on 30.07.2026, a memo signed by Mr. A.P. Bose has been filed stating that they do not have any instructions to proceed with the case. 4. In view of the said memo, report had been called for from the learned District Judge, Jagatsinghpur regarding status of RFA No. 08 of 2009. 5. Report dated 06.08.2026 of the learned Additional District Judge, Jagatsinghpur has been received, where it is stated that RFA No. 08 of 2009 has been dismissed as withdrawn on 15.09.2021. 6. Hence, nothing remains to be decided in the CMP which is accordingly dismissed. 7. Interim order passed earlier stands vacated. 8. Misc. Case No. 1191 of 2016 stands disposed of.
