This CMP has been filed challenging the order dated 11.05.2016 passed by the learned Civil Judge (Junior Division), Sambalpur in C.S. No. 73/128/06 of 2011 (Annexure-7), by which the two petitions have been filed by the plaintiffs on 28.03.2016 and in one petition dated 28.03.2016, they have prayed for deferring of hearing of the petition dated 11.01.2016 filed by the defendant No.4 till disposal of the petitions filed under Order 19 Rule 2 of the CPC. 2. On 08.08.2016, while issuing notice this Court had stayed the operation of the order dated 11.05.2016 passed by the learned trial Court. 3. On 30.07.2026, the matter had been adjourned today to enable the learned counsel for the Parties to inform the Court whether the suit is still pending. 4. Today, when the matte is taken up, Mr. Debaraj Mohanty, learned counsel for the Opposite Party No.7 submits that the suit has been withdrawn by the plaintiff on 12.09.2023. He files a Photostat copy of the certified copy of the order, which is taken on record. 5. In view of the withdrawal of the suit, nothing remains to be decided in this CMP, which is accordingly dismissed. 6. Interim order stands vacated and Misc. Case No. 917 of 2016 stands disposed of.
