This CMP has been filed challenging the common order dated 08.07.2016 passed by the learned Additional Civil Judge (Junior Division), Bhubaneswar in Civil Suit No.97/2011, allowing the application of the plaintiff under Order 6 Rule 17 of the CPC for amendment of the plaint. 2. While issuing notice on 29.07.2016 this Court had stayed further proceeding in the suit. 3. Mr. P.K. Barik, learned counsel appearing on behalf of Mr. Niranjan Lenka, learned counsel for the Petitioner submits that the matter has become infructuous and the suit has been disposed of in the meanwhile. 4. He files a Memo signed by Mr. H.K. Mohanta, learned counsel for the Petitioner, the same is taken on record. 5. Ms. P.S. Mohanty, learned counsel is present on behalf of Opposite Parties No.1, 2 and 3 and supports the submission of the learned counsel for the Petitioner. 6.
