This CMP has been filed by the Petitioner (Plaintiff) challenging the common order dated 18.03.20216 passed in Civil Suit No.54 of 2013 by the learned Civil Judge (Senior Division), Balangir allowing the application of the defendant to file certain documents and rejecting the application filed by the plaintiff to recall order dated 06.01.2016 where prayer has been made to permit the plaintiff to adduce further evidence had been rejected. 2. Vide Order dated 08.08.2016 notice had been issued in the matter and further proceeding in Civil Suit No.54 of 2013 had been stayed. 3. Mr. Umesh Chandra Biswal, learned counsel appearing on behalf of Mr. H.S. Mishra, learned counsel for the Petitioner submits that in the meanwhile, the suit has been disposed of, so the CMP has been rendered infructuous. 4. Mr. Trilochan Nanda, learned counsel appearing on behalf of the Opposite Parties No.1 to 3 confirms the submission of Mr. Umesh Chandra Biswal, learned counsel. 5.
