1. This CMP has been filed challenging the order dated 10.05.2016 passed by the learned Civil Judge (Senior Division), Jajpur in Civil Suit No.612 of 2014, rejecting the application of the Defendant No.6 to accept his written statement which had been filed after delay of 13 months.
2. Mr. M.R. Das, learned counsel files a memo, signed by Mr. Ashok Das, learned counsel for the Petitioner stating that the Civil Suit which had been filed for partition, has ended in a compromise for which the Petitioner, who is Defendant No.6
in the suit, does not want to proceed in this CMP. The said memo is taken on record.
3. In view of the submission that the civil suit has ended in a compromise, no useful purpose would be served by keeping this CMP pending, which is therefore dismissed.
4. All the interim application(s) stand disposed of.
