This CMP has been filed challenging the order dated 20.05.2016 passed by the learned 2nd Additional Civil Judge (Senior Division), Balasore in Civil Suit No.12 of 2013 under Annexure-1, rejecting the application for appointment of Commissioner. 2. While issuing notice on 15.07.2026 this Court, has stayed proceedings in the suit. The matter has thereafter been listed today. 3. Mr. A.P. Bose, learned counsel appearing for the Petitioner submits that in the meanwhile, the suit has been disposed in terms of a compromise between the parties. Hence the CMP has been rendered infructuous. 4. In view of the above submissions, no useful purpose would be served by keeping the CMP pending, for which the same is disposed of. 5.
