This CMP has been filed challenging the orders dated 25.07.2016 and 12.08.2016 passed by the learned Civil Judge (Senior Division), Umerkote in C.S. No. 48/2015 rejecting the two petitions filed by the plaintiff, one under Order 6 Rule 17 of CPC for amend the plaint and another petition under Order 1 Rule 10 CPC to add some persons as defendants. 2. Mr. Basudev Mishra, learned counsel for the Petitioners is present but he submits that he does not have any instructions regarding present status of the suit. 3. It appears that interim order had been passed staying further proceedings in the suit on 21.09.2016 and this order puspa had thereafter been extended. When the matter was listed on 17.01.2017, interim order had not been extended. Hence, it can safely be presumed that in the meanwhile, the suit has been disposed of. 4. Hence, the CMP is dismissed. 5. However, liberty is granted to the Petitioners for revival of the CMP within a period of four weeks in case cause of action still survives. 6.
