This CMP has been filed challenging the order dated 26.11.2015 passed by the learned Civil Judge (Junior Division), Deogarh in C.S. No. 03 of 2015, rejecting the application filed by the Petitioner under Order 6 Rule 17 read with under Order 1 Rule 3 of the CPC for amendment and for addition of parties and for grant of leave to sue without issuing statutory notice to the Government. 2. On 07.09.2016 while issuing notice, further proceeding in C.S. No. 03 of 2015 in the Court of the learned Civil Judge (Junior Division), Deogarh had been stayed by this Court. 3. After 30.09.2019, the case has been listed today. 4. No counsel appears on behalf of the Petitioner or Opposite Parties No. 1 ; Opposite Parties No.3, 4, 6 ; and Opposite Parties No. 8 and 13. 5. Considering the fact that more than seven years have elapsed in the meanwhile, it can be safely presumed that the suit must have been disposed of in the meanwhile. 6. The CMP is accordingly dismissed. 7. However, liberty is granted to the Petitioners for revival of the CMP within a period of four weeks in case cause of action still survives.
