(Through hybrid Mode) 1. The CMP has been filed challenging the order dated 18.03.2016 passed by the learned Civil Judge (Senior Division), Khordha in C.S. No.368 of 2010 allowing the application filed under Order 6 Rule 17 by the plaintiffs (petitioners) subject to payment of Rs.500/- as cost to the defendants. 2. None appears for the petitioners when matter is called. 3. While issuing notice on 19.07.2016, further proceedings in C.S. No. 368 of 2010 pending before the Court of the learned Civil Judge (Senior Division), Khordha, had been stayed by this Court. Thereafter, the matter has not been listed before this Court. As nearly ten years have elapsed since then, Utkalika and no counsel appears on behalf of the petitioners, it can safely be presumed that the said civil suit has, in the meantime, been disposed of. 4. The CMP is, therefore dismissed. 5. However, liberty is granted to the petitioner for revival of the CMP within four weeks, in case any cause of action still survives. 3.
