This CMP has been filed challenging the order dated 19.05.2016 passed by the learned Civil Judge (Senior Division), Aska in C.S. No. 4/2015 (CIS No. C.S./0000195/2015) refusing the amendment sought for in paragraphs 2 (b) and 2 (d) of the application filed under Section Order 6 Rule 17 of the CPC by the plaintiff-Petitioner. 2. None appears for the Petitioner when the matter is called. 3. Mr. B.K. Mohanty, learned counsel is present on behalf of the Opposite Parties No.1 and 3. 4. Since the suit is of the year, 2016 and no counsel appears puspa on behalf of the Petitioner, it can safely be presumed that in the meanwhile, the suit has been disposed of. 5. Hence, the CMP is accordingly disposed of. 6. However, liberty is granted to the Petitioner for revival of the CMP within a period of four weeks in case cause of action still survives. 7.
