Sahu, Petitioner in Person and Mr. P.K. Panda, learned Addl. Standing Counsel appearing for the Opp. Parties. 3. Even though the present writ petition has been filed inter alia challenging non-inclusion of the Petitioner’s name under the Career Advancement Scheme, but in course of hearing Dr. Sahu contended that basing on the order passed by the Hon’ble Apex Court in Review Petition filed by the State arising out of SLP(C) No. 5587 of 2011, Hon’ble Apex Court granted liberty to the Petitioner to make appropriate application for extension of any consequential benefit and for its consideration by the State. 3.1. It is contended that in terms of the order passed in Review Petition No. 2561 of 2016 arising out of SLP No. 5587 of 2011 vide order dd.20.03.2017, Petitioner though is repeatedly approaching Opp. Party No. 1 for consideration of his grievance, but the same is yet to be considered. It is accordingly contended that appropriate Page 2 of 3. direction be issued to comply the direction of the Apex Court so passed in the Review Petition. 4. Learned Addl. Standing Counsel also fairly contended that Hon’ble Apex Court while disposing the Review Petition so filed by the State has permitted the Petitioner to make his grievance for extension of any other consequential benefit. 4.1. It is contended that on consideration of such claim of the Petitioner, Govt. vide notification dtd.03.06.2017 under Annexure- D/1 to the additional affidavit filed pursuant to order dtd.01.08.2023 of this Court, give due placement to the Petitioner as a Lecturer (Sr. Scale) and Reader on ad hoc basis in the scale of pay of Rs.3,000- 5,000/- or Rs.10,000-15,200/- or Rs.15,600 -39,100/- + Rs.7,000/- AGP and Rs.3,700-5,700/- or Rs.12,000 – 18,300/- or Rs.15,600 - 39,100/- + Rs.8,000/- AGP respectively w.e.f. the date mentioned against the name of the present Petitioner under column 4 and 5. 4.2. It is contended that basing on such notification issued by the Govt., Principal Christ College vide letter dtd.04.08.2023 under Annexure-F/1, has quantified the requirement at Rs.19,51,852/- for the period from 01.10.2017 to 31.10.2020. It is accordingly contended that since order passed in Review Petition has already been implemented with passing of the order vide notification dtd.03.06.2017, Petitioner has got no further grievance. 5. Dr. Sahu, Petitioner who appears in Person on the other hand contended that Petitioner is aggrieved with the notification dtd.03.06.2017 and the benefit extended vide the said notification is not in terms of the order passed by this Court and further order passed by the Apex Court in SLP(C) as well as in Review Petition. It is Page 3 of 3. contended that seeking modification of such order so issued vide notification dtd.03.06.2017, Petitioner though has approached Opp. Party No. 1 time and again starting from 21.07.2017, but no decision has been taken as yet. 6. Having heard learned counsel appearing for the Parties and considering the submission made, this Court while disposing the writ petition, grants liberty to the Petitioner to make a fresh application with regard to the wrong committed by the Department while extending the benefit vide notification dtd.03.06.2017 and the further benefit that the Petitioner is otherwise entitled to get basing on the order passed by the Apex Court in the Review Petition. 6.1. It is observed that, if any such application will be moved before Opp. Party No. 1 within a period of two (2) weeks hence, Opp. Party No. 1 shall take a lawful decision on the same within a period of eight (8) weeks thereafter.
