This CRLMC has been filed challenging the order dated 29.08.2016 passed in CMC No. 01 of 2005 by the learned SDJM, Patnagarh (Annexure-2) directing for payment of Rs.500/- per month to his wife (Opposite Party No.1) and a sum of Rs.1,000/- to his son (Opposite Party No.2) from the date of filing of the Misc. Case, i.e. on 03.01.2005 and order dated 07.10.2016 passed in Criminal Revision No. 07 of 2016 passed by the learned Additional Sessions Judge, Patnagarh (Annexure-3) partly allowing the Revision and directing for payment of maintenance of Rs.1,000/- per month to the son Sibashankar Mallick only. 2. Notice of this application had been issued on 06.02.2023 for the first time to this Opposite Parties. Thereafter, the matter had been listed on 06.03.2023, 15.03.2023 and 26.06.2024. As it appears no interim order has been passed in this CRLMC. 3. Mr. H.S. Mishra, learned counsel for the petitioner submits that he has not been able to contact the petitioner over telephone numbers provided by him. 4. Mr. J. Behera, learned counsel who is appearing on behalf of the Opposite Parties is also not in a position to inform this Court whether the impugned orders have been complied with. 5. Since the original maintenance order passed by the learned SDJM, Patnagarh has been passed on 29.08.2016 and more than 9 years have elapsed in the meanwhile and no interim order had been passed in this Court, I am not inclined to keep this case pending any further. 6. The CRLMC is accordingly disposed of granting liberty to the petitioner for revival of the CRLMC in case the cause of action still survives.
