UNNI KRISHNAN NAIR ORDER Date : 24.07.2026 Heard Mr. D Gogoi, Learned Counsel appearing for the Petitioner. Also heard Mr. S C Keyal, Learned Senior Counsel for the Respondents. Mr. D Gogoi, Learned Counsel appearing for the Petitioner has submitted that in pursuance to the directions passed, vide judgment and order dated 25.06.2015 in WP(C) No. 861/2014, the Petitioner has been appointed as Constable (General Duty- 2012), in Central Reserve Police Force (CRPF). Mr. D Goswami, submits that the said decision of the Coordinate Bench of this Court, was carried upon appeal by the Respondents, by way of instituting a Writ Appeal being W.A No. 9/2018. The Division Bench of this Court, vide order dated 13.09.2023, had dismissed the said Writ Appeal. However, it was provided, therein, that the appointment, if effected, in respect of the Petitioner, shall be made effective, from the date on which the candidates, lower in merit to him, were appointed in services. It was further clarified that the Petitioner shall be entitled to only notional monetary benefits, from the date on which such candidates were appointed and actual financial benefits, shall accrue to the Petitioner from the date he joins the post. Mr. S C Keyal, Learned Senior Counsel for the Respondents has clarified that the Page No.# 4/4 Petitioner, on joining the services, in pursuance to the offer of appointment issued to him on 13.07.2026, the directions passed by the Division Bench of this Court, vide judgment and order dated 13.09.2023, in the Writ Appeal No. 09/2018, shall be complied with. In view of the appointment, now being effected, in case of the Petitioner, as well as, the submission of Mr. S C Keyal, Learned Senior Counsel for the Respondents, this Court finds that there is no willful or deliberate violation of the directions, passed by this Court, vide judgment and order dated 25.06.2025 in WP(C) No. 861/2024. Accordingly, the present Contempt Petition stands closed. Notices issues stand recalled. It is, however, provided that in the event the Petitioner, after joining his services, has any grievance, with regard to the manner in which his pay and allowances have been so fixed, it will be open to the Petitioner to approach this Court, by way of instituting appropriate proceedings. A copy of the order dated 13.07.2026, as furnished by Mr. S C Keyal, Learned Senior Counsel for the Respondents, is kept on record and marked as ‘X’ for the purpose of identification.
