Mr. U Bharadwaj, learned counsel appearing on behalf of Mr. T R Deuri, learned counsel for the appellant submits that the appellant in the instant case has expired and to substantiate the statement, he has placed the death certificate, which reflects that the appellant, namely, Biju Kalita, had expired on 08.06.2023 and as such, he submits that the instant appeal gets abated under Section 435 of the BNSS, 2023. As such, the present appeal may be closed, on being abated.
