This CMP has been filed challenging the order dated 07.08.2015 passed by the leaned 1st Additional District Judge, Khurda in FAO No.10 of 2014 (Annexure-3), partly allowing the FAO and setting aside order dated 27.08.2014 passed by the learned Civil Judge (Senior Division), Khurda and temporarily injuncting the respondents-Opposite Parties from evicting the appellants from certain portion of the land and permitting them to utilize the rest portion of the lands in Hal Suit Plot No.41 of 135 for their own purpose or public purpose till disposal of the suit. 2. On 22.07.2026 prayer for adjournment was made on behalf of learned counsel for the Petitioner and the CMP had been adjourned, calling for a report from the learned trial Court regarding status of the suit. 3. Report dated 28.07.2026 has been received from the learned Civil Judge (Senior Division), Khurda where it is stated that Civil Suit No. 78 of 2014 has been disposed of on 24.01.2020. 4. In view of the disposal of the suit, nothing remains to be decided in the CMP, which is therefore dismissed. 5. Interim order stands vacated and Misc. Case No.1749 of 2015 stands disposed of.
