This CMP has been filed challenging the order dated 17.08.2015 passed by the learned Civil Judge (Senior Division), Balasore in C.S. No. 551 of 2013-I allowing the application under Section 10 of the CPC filed by defendants No. 10 for staying the suit. 2. Notice had been issued in this application on 03.02.2016, but no interim order had been passed. 3. On 22.07.2026, the matter has been adjourned on the prayer of learned counsel for the Petitioner to obtain instructions. 4. Today when the matter is taken up learned counsel for the Petitioner files a memo stating that she has no instructions from the Petitioner. The same is taken on record. She also submits that RSA No. 194 of 2004 is listed for hearing in this Court. 5. Considering the fact that while issuing notice, no interim order has been passed on that date or thereafter, no useful purpose will be served by keeping the CMP pending, which is accordingly dismissed. 6. In view of the disposal of the case, no order is required to be passed regarding substitution of Opposite Party No.10. 7. All pending interim applications stand disposed of.
