No. 111 of 2008 rejecting the application of the Petitioner for substitution of deceased – defendant no.1 and the condonation of delay as because the said application had not been accompanied by a petition to set aside the abatement of the suit. 2. Mr. J.R. Kar, learned counsel for the Petitioners submits that in the meanwhile the suit has been disposed of. Hence the CMP has become infructuous. 3.
