W.P.(C) No.5106 of 2015
Nirakar Sahoo …. Petitioner Mr. S. Prusty, Advocate
-versus- MD, OFDC Ltd. and Others ….
Opposite Parties Mr. P. Parida, Advocate on behalf of Mr. B.K. Sharma, Sr. Advocate for O.P. No.1
CORAM:
JUSTICE BIRAJA PRASANNA SATAPATHY
Order No.
ORDER 07.07.2026
06. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel for the parties.
3. The present Writ Petition has been filed inter alia challenging order dated 06.02.2015, so passed by the Opp. Party-Corporation under Annexure-8. Vide the said order, period of service rendered by the petitioner from 01.05.2014 to 31.05.2014 was treated as “No Work No Pay” on the ground that petitioner during the said period, absconded from his headquarter and did not perform any work in Kurtamgarh SWC No.VIII.
4. Even though learned counsel for the petitioner contended that on the face of discharging duty during the aforesaid period, that period was treated as “no
work no pay”, but on being confronted, learned counsel for the petitioner failed to show any document enclosed to the writ petition showing discharge of duty by the petitioner for the period 01.05.2014 to 31.05.2014. Since no document is enclosed to the Writ Petition, showing discharge of duty by the petitioner during the aforesaid period, this Court is not inclined to interfere with the order dated 06.02.2015, so passed by O.P. No.3 under Annexure-8.
5. The Writ Petition stands dismissed accordingly.
