This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode. 2. Heard learned counsel for the parties. 3. It is fairly contended in the Bar that the impugned order was passed on 12.11.2014 under Annexure-5 by the Opp. Party-Bank, wherein claim of the petitioner for release of the benefit was rejected and it was indicated that such release will be subject to disposal of W.P.(C) No.10183 of 2008. 3.1. It is fairly contended that W.P.(C) No.10183 of 2008 in the meantime has been dismissed vide order dated 17.01.2018. 4. Considering the fact that W.P.(C) NO.10183 of 2008 has since been dismissed vide order dated 17.01.2018, this Court while disposing the Writ Petition, permits the petitioner to move an appropriate application before Opp. Party No.3 for release of the benefit which is the issue in the present writ petition. It is observed that if any such application will be filed before Opp. Party No.3 within a period of 3(three) weeks hence, Opp. Party No.3 shall take a lawful decision on the same within a period of 3(three) months from the date of receipt of such application. 5.
