ORDER 19.05.2026 01. It has been fairly submitted by Mr. F.A. Wani, learned counsel for the petitioner, that the judgment passed by the learned Writ Court on 14th July, 2015 in OWP No. 248/2013, which is the subject matter of the instant contempt petition, stands complied with to the extent of release of rental compensation in favour of the petitioner by the Police Headquarters, Jammu and Kashmir, vide Order No. 4673 of 2025 dated 20th December, 2025, based on the assessment made by the District Rent Assessment Committee (DRAC), Srinagar in its 25th meeting held on 23rd November, 2024, read with communication dated 8th July, 2025 issued by the District Rent Assessment Committee, as reflected in the fresh compliance report filed by respondent Nos. 1 to 4 on 8th May, 2026. 02. Mr. Wani, learned counsel for the petitioner, submits that an amount of Rs. 35,62,841/-, the details whereof are reflected in the fresh compliance report, has already been received by the petitioner. However, he submits that the rental compensation in respect of the adjoining/appurtenant land attached to the structure has not been paid to the petitioner till date and, to that extent, the judgment is yet to be complied with. 03. Mr. Mohsin S. Qadri, learned Senior Additional Advocate General, submits that insofar as the rental compensation for the adjoining/appurtenant land is concerned, the same shall be considered subject to production of the consolidated occupation certificate and, upon receipt thereof, the same shall be forwarded to the Police Headquarters, Jammu and Kashmir, for accord of sanction regarding rental compensation for the adjoining/ appurtenant land. 04. In view of the stand taken by the respondents in the fresh compliance report, the petitioner is directed to submit the consolidated occupation certificate in respect of the adjoining/ appurtenant land before the respondents within a period of one week from today. Subject to th e production of the said certificate, the respondents shall assess the rental compensation for the adjoining/appurtenant land expeditiously and release the same in favour of the petitioner, preferably within a period of two weeks thereafter. 05. In light of the stand taken by the respondents and the further directions issued by this Court hereinabove, nothing further survives for adjudication in the instant contempt petition. Accordingly, the proceedings in the contempt petition are closed. Rule, if any, shall also stand discharged. 06. It is, however, made clear that in the event the judgment/order passed by the learned Writ Court, read with the directions passed by this Court today, is not complied with within the aforesaid period, the petitioner shall be at liberty to seek revival of the contempt petition and, in such eventuality, this Court shall be constrained to take coercive measures against the respondents.
