The petitioner has prayed for issuance of writ of mandamus, to direct the respondents not to retire him on attaining the age of 58 years by enforcing the provisions of SRO 233 of 1988. 02. This petition came up for consideration on 26.11.2015, when this Court while issuing notice to the respondents also permitted the petitioner to continue beyond the age of 58 years on his own risk. 03. Be that as it may, the petitioner has prayed for his continuation in services up to the age of 60 years which he completed pursuant to the order passed by this Court. Apart from this, the issue as to whether an employee of Cooperative Societies is entitled to retire after the attaining the age of 60 years on a par with a Government employee has already been set at rest. It has been held by this Court that the superannuation of employee of the Co-operative society is Sr. No.35 H I G H C O U R T O F J A M M U & K A S H M I R A N D L A D A K H 2 governed by its by-laws and SRO 233 of 1988. 04. There is no merit in this petition and perhaps this is the reason that the petitioner has decided not to pursue this petition. 05. In view of the above, the instant petition, is dismissed for non- prosecution, along with connected application(s). 06. Interim direction, if any, shall stand vacated.
