1. Mr. Girija Prasad Dutta, learned counsel for the Appellant- Insurance Company and Mr. P.C. Pattanaik, learned counsel for the Claimants-Respondents No.1 to 3 are present. Mr. Bibekananda Bal, Manager (Legal) of the Appellant-Insurance Company is also present.
2. This appeal has been filed by the Appellant-Insurance Company, challenging the judgment and order dated 27.01.2015 passed by the learned District Judge-Cum-MACT, Phulbani in M.A.C. Case No. 26 of 2009 directing the Appellant-Insurance Company to pay an amount of Rs.14,24,000/- (Rupees fourteen lakh twenty-four thousand) only to the Respondents No.1 to 4 along with interest at the rate of 6% per annum from the date of filing of the claim petition, i.e., from 27.08.2009 within a period of two months.

In full and final settlement of the claim, it is now agreed between the Appellant-Insurance Company and the Respondents No.1 to 4-Claimants that consolidated amount of Rs.22,50,000/- (Rupees twenty-two lakhs fifty thousand) only which includes interest, shall be paid by the Appellant-Insurance Company to the Respondents No.1 to 4-Claimants within a period of eight weeks.
4. The compromise memo signed by Mr. Girija Prasad Dutta,
learned counsel for the Appellant-Insurance Company, and P.C. Pattanaik, learned counsel for the Claimants-Respondents No. 1 to 3 is filed and taken on record.
5. It is, therefore, directed that the Appellant-Insurance Company shall deposit the aforesaid consolidated amount of Rs.22,50,000/- (Rupees twenty-two lakhs fifty thousand) only, which includes interest, within a period of eight weeks from today before the Tribunal. The said amount shall be apportioned, invested and disbursed as per direction of the Tribunal.
6. As the settlement is arrived at before the National Lok Adalat, no court fee shall be levied. On production of proof of deposit, the statutory amount shall be refunded to the Appellant-Insurance Company along with accrued interest, on proper application.
7. The MACA is accordingly disposed of.
8. Urgent certified copy of this order be granted on proper application.
