Learned counsel for the respondents submits that this petition has become infructuous because the investigation has already been concluded by way of filing of the charge-sheet. 2. In the status report filed by the respondents, it has been asserted that the case FIR No. 63/2014 under Sections 447, 336, 323 & 147 RPC registered by the Police Station, City Jammu has been concluded into charge-sheet, by which the offence under Section 447 RPC has been deleted, whereas offences under Sections 336, 323 & 147 RPC stands proved against the accused, namely, Amar Singh, Amit Singh, Bachan Singh and Pawan Kumar and that the charge-sheet is pending before the trial Court. 3. Given the aforesaid background, once the FIR has been concluded into final charge-sheet and given the nature of investigation CRMC No. 70/2015 Page 2 of 2 conducted, this Court does not see any requirement to continue with the present proceedings because nothing has been brought to the notice of this Court that the FIR is tainted or was lodged with the malicious intent. Resultantly, this petition has got no merit and the same is, accordingly, dismissed along with connected application.
