1. Applicant seeks regular bail in case FIR No. 0811/2021 registered at Police Station Ranhola for commission of offences under Sections 302/307/147/148/149/34 IPC. 2. Ms. Anu Narula, learned counsel for applicant submits that applicant has been falsely implicated in the present matter and she has no role to play in the incident in question wherein one person, unfortunately, lost his life. She submits that FIR was registered at the instance of injured Amit Srivastava. He is material eyewitness as well and in his report, he, categorically, claimed that two persons, namely, Vikas and Aman had come on a scooty and they both entered into scuffle with him and also started assaulting him. made reference to accused Prince and his other accomplices who were also present at the spot. According to FIR, he was caught hold by the accused and thereafter, accused Aman took out a knife from his pocket and attacked his maternal uncle i.e. Manoj. Such knife blow proved fatal as Manoj succumbed to such injuries. According to Amit, he was also not spared and he was also attacked by the accused and received a knife blow on his left thigh. He claimed that all accused persons had beaten up his brother-in-law Sanjeev. Amit also claimed that he could identify all the accused persons including Prince, Heena (applicant herein), Ajay, Aman, Vikas and others. 3. Fact remains that no specific role was ascribed or attributed to applicant Heena. FIR is though silent on said aspect, during investigation, it came to fore that she had exhorted her co-accused in this regard. Learned Addl. P.P. for State submits that 16 out of 40 cited witnesses have already been examined. 4.
Nominal Roll of the applicant has been received which indicates her incarceration period of four years and eight months, already. Her jail conduct is recorded as satisfactory. 5. Informant/inured Amit has already been examined. 6. During course of consideration, learned counsel for applicant also submitted that during incarceration, applicant was also having her minor child with her and it was only after he turned five, he is no longer with her in the jail. 7. Be that as it may, since there is no immediate prospects of trial getting concluded in near future and since incarceration period is already substantially high, this Court, albeit, without expressing any opinion over the merits of the case, is inclined to enlarge applicant on bail while also This is a digitally signed order. considering the fact that applicant is lady. 8. Accordingly, applicant is admitted to bail on her furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of concerned learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions:- a) Surety would be local. b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. c) Applicant shall not leave Delhi without prior permission of the learned Trial Court. d) Applicant shall not try to influence, intimidate or coerce any witness, directly or indirectly. e) The applicant/accused shall provide her mobile number to the investigating officer and shall keep the same operational till the disposal of the case. 9. The application stands disposed of in aforesaid terms. 10. A copy of this order be sent to the concerned learned Trial Court and also to the Jail Superintendent for necessary information and compliance.
