Order 1. Vide order dated 6.5.2015, the Joint Registrar had recorded that the counter claimant had failed to produce its witnesses and nor have the costs imposed vide order dated 29.1.2015 for failing to file the list of witnesses along with the affidavits by way of evidence, been paid. Further, it was recorded that sufficient opportunities had been granted to the counter claimant to conclude the ex-parte evidence, but to no avail. 2. It is pertinent to note that prior hereto, vide order dated 30.4.2014, as none had been appearing for the plaintiff, the suit was dismissed in default. 3. Learned counsel for the counter claimant submits that his client has not been contacting him for a long time and he has not received any instructions from them despite repeated efforts made by him to elicit instructions. 4. In view of the aforesaid submission made by the counsel for the counter claimant, it appears that the counter claimant is not interested in prosecuting the present counter claim. The same is dismissed for non-prosecution. File be consigned to the record room.
